When you interact with us through the Services, we collect Personal Information and other data from and about you in order to provide the Services (for example, to provide you with the opportunity to earn cash back).
Personal Information That You Provide Through the Services: We collect Personal Information from you when you use the Services and voluntarily provide such information, such as when you create a GetUpside account or upload a receipt to claim a cash rebate. This Personal Information may include:
Your email address and password, if you create a GetUpside account. We use this information to communicate with you and provide you with account security.
A unique social media identifier, and possibly your name and/or email address, if you log in to the GetUpside application using a social media account. We use this information to provide you with account security and to communicate with you.
Your history of GetUpside use, including transaction timestamps, site identifiers, transaction totals, cash back earned, and the first six and last four digits of any credit cards used, if you use our Services and generate cash back offers. We use this information to provide personalized cash back offers to you in the future.
Your credit card receipts from transactions at GetUpside merchant partners, if you upload these receipts to claim cash back offers. We use the information contained on these receipts to update your history of GetUpside offers.
The first six and last four digits of any credit cards you input into your GetUpside wallet, if you choose to use this feature for receiptless transactions. We use this information to enable receiptless check-in at certain partner merchant sites.
Geolocation information, if you enable location services on your mobile device. We use this information to notify you when you are near to one of our merchant partners, and to remind you to use our service to earn cash back.
A list of your contacts, including names and email addresses, if you upload individuals contacts in order to make referrals and generate referral bonuses. We use this information to offer our Services to individual contacts you designate, including referral bonuses.
The name of your financial institution(s) and your bank account number(s), if you choose to ‘cash out’ your GetUpside account by receiving a direct transfer to your bank account. We use this information to send you cash back you have earned.
Your PayPal login email address, if you choose to ‘cash out’ your GetUpside account by receiving a direct transfer to your PayPal account. We use this information to send you cash back you have earned.
Your email address, if you choose to ‘cash out’ your GetUpside account by redeeming an e-gift card. We use this information to send you an e-gift card converted from the cash back you have earned.
Your mailing address, if you choose to ‘cash out’ your GetUpside account by receiving a check. We use this information to send you cash back you have earned.
With respect to each of these categories of Personal Information, GetUpside may store such information itself and/or share such information with the following types of affiliates, agents or service providers: advertising networks, data analytics providers, productivity application providers, payment platforms, cloud storage providers, customer service platforms, and personnel management vendors.
When you interact with GetUpside through the Services, we receive and collect certain personally non-identifiable information. Such information, which is collected directly or indirectly from our merchant partners and also collected passively from your mobile device using various technologies, does not identify you personally. The Services may use such information and pool it with other information to track, for example, the total number of visitors to our Site, the number of visitors to each page of our Site, and the domain names of our visitors’ Internet service providers. It is important to note that no Personal Information is available or used in this process.
In order to process any cash back offers you accept while using the Services, we collect and analyze anonymous credit card transaction data from our merchant partners.
We may also collect information related to your use of the Services (“Log Data”). This Log Data may include information such as your computer’s Internet Protocol (“IP”) address, when and how often you use the mobile application, browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages and other statistics. We use this data to analyze how our users are using the Services and how we can improve and increase the functionality of the Services.
GetUpside conducts research on its customer demographics, interests and behavior based on the Personal Information and other data provided to us, in order to better understand and serve the users of the Services. This research may be compiled and analyzed on an aggregate basis. GetUpside may also disclose aggregated user statistics in order to describe our services to current and prospective business partners, and to other third parties for other lawful purposes.
With respect to each of these categories of other data, GetUpside may store such information itself and/or share such information with the following types of third-party affiliates, agents or service providers: advertising networks, data analytics providers, productivity application providers, payment platforms, cloud storage providers, customer service platforms, and personnel management vendors.
GetUpside is not in the business of selling information that we collect. We consider this information to be a vital part of our relationship with you. There are, however, certain circumstances in which we may share your Personal Information with certain third parties without further notice to you, as set forth below:
Business Transfers: As we develop our business, we might sell or buy businesses or assets. In the event of a corporate sale, merger, reorganization, dissolution or similar event, Personal Information may be part of the transferred assets.
Agents, Consultants and Service Providers: GetUpside, like many businesses, sometimes hires other companies to perform certain business-related functions. Examples of such functions include mailing information, maintaining databases and processing payments. When we employ another entity to perform a function of this nature, we only provide them with the information that they need to perform their specific function.
Legal Requirements: GetUpside may disclose your Personal Information if required to do so by law or in the good faith belief that such action is necessary to (i) comply with a legal obligation, (ii) protect and defend the rights or property of GetUpside, (iii) act in urgent circumstances to protect the personal safety of users of the Services or the public, or (iv) protect against legal liability.
For purposes of the California Consumer Privacy Act, we do not and will not sell your Personal Information. Please note that we may share Personal Information in connection with a Business Transfer, as described above.
You can visit the Site without providing any Personal Information. If you wish to use the Services, it is necessary to provide certain Personal Information such a login information to create an account and transaction information to accept cash back offers. As outlined above, certain Personal Information is integral to enabling certain features of the Services.
If you choose not to provide certain Personal Information, you may not be able to use all features of the Services. This includes cash referral bonuses that GetUpside offers in exchange for sharing your personal contacts so that GetUpside can offer its Services to other users.
Requesting and/or Deleting Your Personal Information
For purposes of this section, “Personal Information” shall mean “personal information” as that term is defined under the California Consumer Privacy Act.
You have the right to know what Personal Information we have collected and how we have used and disclosed that Personal Information. You also have the right to request that we disclose your Personal Information to you. Specifically, you have the right to request from GetUpside: (1) specific pieces of Personal Information that we have collected about you; (2) categories of Personal Information that we have collected about you; (3) categories of sources from which we have collected this information; and (4) the business or commercial purpose for collecting your Personal Information.
You also have the right to request the deletion of your Personal Information from GetUpside. When completing such a request, GetUpside will delete all personally identifiable information (except such information that GetUpside is legally permitted to preserve for narrow business purposes) and will ensure that all other Personal Information we have collected about you is no longer capable of being associated with your personal identity.
GetUpside will not discriminate against you for exercising either of these rights. However, a request to delete your Personal Information will include the deletion of your login credentials, and thus your GetUpside account, which will prevent you from continuing to use the Services.
To request the disclosure and/or deletion of your Personal Information, the following methods are available:
From a mobile device with the GetUpside application installed, touch this link;
Access the Help Center in the GetUpside application and select “Submit a Privacy Request,” under the “Consumer Privacy” heading; or
Email firstname.lastname@example.org with the subject line PRIVACY REQUEST. Please indicate in the text of the email whether you are requesting the disclosure and/or deletion of Personal Information and whether you are a resident of California.
If you submit a privacy request, GetUpside will endeavor to verify and complete your request within 45 days or less. GetUpside may require additional information from you for verification purposes. In accordance with applicable law, GetUpside will require you to re-enter your login credentials in the mobile application prior to our disclosure or deletion of any of your Personal Information. If we cannot verify your identity, we will not disclose or delete your Personal Information.
You may also submit a request to disclose and/or delete your Personal Information through an authorized agent. If you do so, the agent must present signed written permission from you to act on your behalf and you may also be required to independently verify your identity with us.
You may also have the option of posting your Services activities to Social Networking Services when you access content through the Services (for example, you may post to Facebook that you performed an activity on the Service); you acknowledge that if you choose to use this feature, your friends, followers and subscribers on any Social Networking Services you have enabled will be able to view such activity.
GetUpside takes commercially reasonable steps to protect the Personal Information provided via the Services from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. However, no Internet or email transmission is ever fully secure or error free. In particular, email sent to or from the Services may not be secure. Therefore, you should take special care in deciding what information you send to us via email. Please keep this in mind when disclosing any Personal Information to GetUpside via the Internet.

To keep your Personal Information accurate, current, and complete, please contact us as specified below. We will take reasonable steps to update or correct Personal Information in our possession that you have previously submitted via the Services.
